III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete quarterly inspection of the surtace facility areas and office records at the <br />McClave Canyon Mine. The inspection was conducted by Dan Mathews of the DMG Grand <br />Junction Field Office, accompanied by Henry Austin of the Office of Surface Mining Reclamation <br />and Enforcement (OSM), Denver office. This was a complete OSM oversight inspection. <br />Inspectors were accompanied by Walter Whitledge, Mine Manager. Weather was clear and mild, <br />surtace soils were moist from recent precipitation. Coal was being conveyed out of the mine and <br />loaded into trucks for transport to Cameo Plant during the inspection. <br />NOV Status Update <br />One enforcemen, action (NOV CV-2005-008) had been issued on October 26, 2005, following the <br />Division's inspection of October 25. The NOV was issued for failure to maintain upland diversion <br />and haul road culverts; three of which were found to be completely or partially blocked by <br />sediment during the 10/25/05 inspection. One additional haul road culvert (Culvert "J") was found <br />to be more than'/ blocked by sediment at its upper end during the inspection on November 1. <br />This culvert blockage had apparently been missed on the previous inspection, and the NOV was <br />modified to include Culvert "J" on November 1. Clean-out of Culvert "J" is also required by <br />November 9, 2005. <br />Significant progress had been made towards abatement of the NOV. 18" upland Culvert "E" had <br />been fully cleaned out, as had 42" haul road Culvert "H". The 42" upper diversion Culvert "D" <br />clean-out was in progress, but had not yet been completed. The buried culvert was partially <br />blocked along a segment of 150' or more. For the most part, the culvert has to be cleaned out <br />manually, by personnel with shovels and buckets, working from several access points. This <br />process was in progress. A large track-hoe had been rented to perform the Culvert "H" clean-out <br />and other necessary maintenance work. The track-hoe was still on site. <br />Availability of Records <br />Records were on file and up-to-date, through the 2"d Quarter, 2005. 3rd Quarter hydrology <br />monitoring, pond inspection, and NPDES monitoring report records were recently received by <br />DMG, but had not yet been incorporated into the records books at the mine office. <br />The CDPS Discharge Permit (CO-0038342) was renewed effective 9/01/04. The permit contains <br />a provision that specifies the Materials Containment Plan is to be updated within 90 days of the <br />CDPS permit effective date. The updated Materials Containment Plan could not be located, and <br />may not have been completed. The most recent update located was completed in 2000. The <br />Division has contacted the Water Quality Control Division (WQCD) regarding this matter, and is <br />awaiting response from WQCD. The operator will be advised of the WQCD response when <br />received. <br />
