III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Coal Gulch Mine was conducted by DMG staff from the Durango Office, <br />701 Camino del Rio, Room 125, Durango, CO 81301, (970) 247-5469. The permit has been revoked; <br />financial warranty was forfeited and utilized for final reclamation. <br />No activities were observed; no individuals were contacted during the inspection. Snow cover, <br />approximately 12 inch depth covered most portions of the permit area. Numerous tracks of wildlife <br />were observed in the snow cover; however, no tracks of humans or vehicles were observed in the <br />snow cover. <br />Sediment pond was holding water. Water depth was visually estimated at 1.5 feet. Primary and <br />secondary spillways for the pond had previously been removed by landowner activities. Minor water, <br />approximately 4-inch depth, was impounded in a low-lying area at the north end of the permit area. <br />Water was not flowing in the Coal Gulch stream channel. The landowner has reconfigured the <br />alignment of the channel. <br />Industrial debris, imported by the landowner, has been stockpiled on site <br />
