III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. Jerry Nettleton of BTU-Empire Corp. <br />accompanied the inspection and provided access to the records. The mine is in Temporary Cessation. No active <br />mining activity is occurring on the mine site. Mine site was damp and temperatures were mild, approximately <br />mid 60's. <br />Records: Records were checked at the mine office. Records list accompanies this report. <br />Roads: Roads are in good condition through out mine site. No problems were identified on the roads. The <br />operator is looking into allowing non-mine personnel use of the warehouse at the No. 5 portal facilities. BTU EC <br />would consider gating off roads to restrict public access if this potential wazehouse use moves forward. The main <br />access road, the access road by the Brazel-Simms area, and the access ramp to the Williams Fork reclaimed Pit 1 <br />are all gated at Highway 13. Only mine personnel or authorized parties are currently provided with access. <br />Hvdroloeic Balance: The mine has received recent precipitation. There is no rain gauge at the mine site, so an <br />accurate record of recent precipitation at the mine site is not available, Ground surface is damp, snow is actively <br />melting throughout the site. Most of the snow pack is already melted with the exception of drifted areas. <br />Pond conditions: <br />Pond Name Outfall Number Comments <br />5-P1 007 D <br />5-P2 D <br />5-P3 D <br />5-P5, P6, P7 Tmt. ponds Currently pumping mine water 0.8 of staff gauge. Discharge is clear with <br />no sulphuric odor. Bits of old algae are being discharged. One burrow <br />was observed near the waterline on the west side of SP-5. \water is <br />observed pooled at the toe of the outslopes. This water appears to be due <br />to recent snowmelt. <br />SA-Pl 009 Pond is holding a pool of slightly cloudy water several feet below <br />s illwa .Gated riser is underneath lar a rabbitbrush.* <br />9-Pl Incised ond, holdin a snowdrift and small uddle due to snowmelt. <br />9-P2 The pond is holding a pool of slightly turbid water approximately 4 feet <br />below the spillway discharge elevation. The operator is currently not <br />um in from North An le 7 um . <br />9-P3 024 Pond is dam but not holdin a ooI of water. <br />9-P4 014 D <br />9-PS 017 D <br />9-P6 O15 D <br />9-P7 013 D <br />9-P8 016 D <br />9A-P1 Ol8 Holding a good pool of clean water.
