Present at the inspection were Kate Pickford, DMG, Connie Davis and Bill Rose, Aggregate Industries -WCR, Inc., and Bill Schenderlein, Applegate Group, Inc. Weather at the time of the inspection was clear, calm, and approximately 70 degrees. 2. The area contained in the acreage release request consists of 18 acres lying in the southern section of the current permit. The area is privately owned by Robert Baumgartner and lies on both the east and west sides of the South Platte River. Stockpiles of material are located on the area, however, this material is imported from off site for processing in a redi-mix plant that Mr. Baumgartner runs on the property. There is no sign of excavation on the area to be released and the Operator has not disturbed any of the property contained in the release request. The area contained in the release request that is on the west side of the South Platte River has not been disturbed. 3. According to the Operator, the acreage represented in the release request area was not intended to be mined in the original permit and was included in the permit area because it was owned by the same property owner as the area to be mined. The Operator has not disturbed the site and desires to remove the area from the permit in conjunction with an Amendment that is adding acreage to the permit. The inspection did not reveal any conditions that would prohibit release of the acreage requested. As long as the Operator can show proof to the Division that the area included in the acreage release request is permitted as light industrial, the acreage release can be approved.
