III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II-W Mine conducted on December 7, 2006 by Mike <br />Boulay of the DRMS. Roy Kazo of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were sunny and cold. The majority of the mine site was snow <br />covered. There was no activity at the mine during the inspection. <br />The Tie-Across Haul Road was icy and snow packed, but passable. Road ditches and road <br />drainage run outs were snow covered along the Tie-Across Haul Road. The main access road to <br />Sedimentation Pond 006 and the road leading up to the dragline and electric substation were <br />accessible. All other mine site roads were entirely snow covered and impassable which restricted <br />access to most azeas of the site. <br />Pond 006 was full and mostly frozen at the surface. Pond 006 was dischazging a small amount of <br />cleaz water. The pond embankment, inlet and dischazge structure was stable and no problems <br />were noted. <br />
