A site inspection was made of the Russell Gravel Pit at the request of Mr. Jim Krakel. <br />Mr. Krakel submitted a request on October 11, 2000 to become the successor operator from <br />Doyle Russell (deceased). Mr. Krakel was present during the inspection. <br />2. The site is located in Larimer County, 4.5 miles north of Wellington on the east Frontage <br />Road of I-25 and 1.2 miles north of the Owl Canyon exit #281. The operation is a sand and <br />gravel pit permitted for a total of 6 acres. The Division currently holds a Letter of Credit <br />in the amount of $6,346.67 submitted by Mr. Russell. The post-mining land use is cropland. <br />The legal description for the site is SE1/4, NW1/4, SE1/4 of Section 3, T9N, R68W, Larimer <br />County. <br />3. This inspector estimated the current disturbance at the pit to be approximately 6.0 acres <br />(440' x 600'). The pit contains a highwall approximately 10' high along the north side; <br />product, overburden, and topsoil stockpiles; a pit floor that has been partially graded; and <br />various areas in varying stages of reclamation. Mr. Krakel has done a good job of performing <br />contemporaneous reclamation by partially backfilling & grading east and south pit slopes, and <br />by grading and topsoiling the west pit slopes. This inspector verified that $1,000/acre <br />would be an acceptable reclamation cost for the existing disturbance. <br />4. Mr. Krakel expressed an interest in modifying the permit to allow for additional acreage <br />~~~' to be disturbed. This can be accomplished by either amending or converting the existing <br />.~ permit following completion of the permit transfer process. Submittal of a properly executed <br />financial warranty of $6,000 either by Mr. Krakel or another party on his behalf and <br />verification that all requirements of Rule 3.1.12 have been met (as noted in Item 5 below) <br />will complete the permit transfer process. The site is currently permitted as a Limited <br />Impact 110(2) operation for a total of 6 acres. Up to 9.99 acres may be permitted under the <br />terms of a Limited Impact 110(2) permit. Therefore, up to 3.99 additional acres may be added <br />by amandiag the existing permit under the terms of Rule 1.10 (see attached copy). The 110(2) <br />amendment fee is $719 and the 110(2) annual fee is $281. The timeframe for a 110(2) <br />amendment is 30 days. Another option available to the successor operator for adding acreage <br />is to convert the existing 110(2) permit to a regular 112 permit under the terms of Rule 1.11 <br />(see attached copy). The regular 112 conversion fee is $2,344 and the regular 112 annual fee <br />is $688. The timeframe for a 112 conversion is 90-120 days. <br />5. A site entrance sign was posted as required by Rule 3.1.12. However, there were no <br />monuments or other markers present that were clearly visible and adequate to identify the <br />boundaries of the 6-acre permit area. Therefore, the Division requests that either Mr. <br />Krakel or a representative of the estate of Mr. Doyle Russell properly mark and identify the <br />boundaries of the 6-acre permit area and submit photographs of completion of this requirement <br />on or before December 31, 2000. See page 4 for corrective actions. <br />
