(Page 2) <br />MINE ID # OR PROSPECTING ID #: rs-~nni_nRs <br />INSPECTION DATE: »/n8/0.'~ INSPECTOR=S INITIALS: a iw <br />OBSERVATIONS <br />This was a standard warranty reduction inspection conducted by Tony Waldron of DMG along with Les Ewegen <br />of 1241h Estates Partners. The inspection was conducted as the result of a financial warranty reduction request <br />submitted by the operator to reduce their financial warranty form $435,500.00 to $51,328.00 on the northeast <br />parcel. This would be a reduction of $384,172.OOof which $224,385.00 would be applied to the southwest <br />parcel of the mine site. This would result in an overall release of$173, 057.00. <br />The site is located just west of U.S. Hwy 85 and in between 124+h Avenue and 120~h Avenue near Henderson, <br />Colorado. There are numerous gravel pits in this area mining the gravel rich alluvial terrace of the Platte River. <br />This pit is situated approximately one mile east of the river on a more upland terrace. The active portion of the <br />site was mined and reclaimed by a previous operator, however, a substantial amount of gravel was never <br />mined before the market soured and the mine was reclaimed. As a result, the current operator decided to re- <br />open the site and complete the mining before reclaiming the pit to a water storage reservoir for the City of <br />Brighton. <br />The permitted area is divided into two working parcels. The first one is at the intersection of U.S Hwy 85 and <br />124+^ Avenue and borders the Fulton Irrigation Canal on the west. The second parcel is southwest of the first <br />and borders 120" Avenue on the south and the Fulton Canal on the east. This area was amended into the <br />permit recently and the full financial warranty has not yet been posted on this site. However, some of the <br />existing financial warranty was shifted over to this site so that preliminary site preparation could begin. <br />The reclamation plan for the first parcel is a clay lined reservoir with 2H:1 V slopes comprised primarily of clay <br />stone excavated from the bottom of the gravel pit. As this work is completed the plan was to release liability <br />associated with various tasks and transfer it over to the second parcel until enough bond was in place to begin <br />mining on that site. The post-mining land use for the second parcel is also a water storage reservoir, however, it <br />will utilize a slurry wall instead of clay backfilled slopes. The plan is to install the slurry wall prior to initiating <br />mining so that the pit can be de-watered once as mining progresses. <br />The clay liner for the first parcel is approximately 80% complete and the seal appears to be solid. The southwest <br />corner is still open to allow for the placement of a pump station in this location. Even with a small breach at this <br />point, the pumping rate has reportedly dropped to less than the allowable 50,000 gallons per day from <br />approximately 1,000,000 gallons per day. Testing for final State Engineer's approval will begin in earnest once <br />the pump station is installed and the final portion of the liner is completed. <br />The operator is requesting release of 80% of the liner installation cost, 100% of the pumping cost and 90% of the <br />mobilization cost. However, since the final leak test has not been conducted, the Division is going to retain 10% <br />of the dewatering cost and all of the mobilization cost. 80% of the liner cost will be released. In addition, a cost <br />is going to be added to the second parcel for re-grading of material that is now stockpiled there from the first <br />parcel. The cost associated with this task is $37,500. This will result in $261,885.00 being associated with the <br />second parcel, $73,615.00 to remain with parcel one and a net release of $100,000.00.
