the barricades are to be removed from the site within tY,e <br />week. <br />Records Review: <br />The records review included observations of the permit and <br />stipulations, the Findings Document, SAF. designs, air <br />emissions permit, Annual Reclamation Report, Quarterly Water <br />Monitoring the NPDES permit, Storm Water Plan, County <br />Conditional Use Permit, bond documents, certificate of <br />liability insurance, public notice of the permit renewal, and <br />the 1993 Annual Hydrology Report. <br />The records review also included observations of selected <br />excerpts from t_he approved mining and reclamation plan. It <br />was some times difficult to locate information that is germane <br />to the current situation at'the Munger Canyon Mine. Y'he <br />reason for this is that much of what as been approved, as <br />reflected in the findings document relates to proposed <br />operations that will occur if the mine ever starts producing <br />coal. In a similar fashion, I was advised that much of the <br />original mine disturbance is prelaw. Therefore design <br />criteria are not applicable as Zong as the permittee <br />demonstrates compliance with the performance standards. Using <br />the access road as an example, when it is reconstructed as <br />described in the approved MRP it will have to meet all of the <br />design criteria as well as the performance standards as will <br />any other structures that will facilitate the mining <br />operations. <br />5 <br />
