Compliance :+ith Colorado Surface Coai ~iivng Reclamation act <br />CZS 1471, as amended 34-33-101, et. sera., <br />and the <br />~RU1es and Reguia tons Issued ?ursuant to the act <br />This includes a Zist:ng of the aarticular provisions of the regulatory program which were <br />examined during the course of ttus inspection, and identii_'es enforcement actions taken <br />during the inspection for failure to comply with the Rules and P.egulations, the act and <br />the permit. <br />9.05 Hydrologic Balance <br />The berm around the coal stockpile area has been trampled by cattle traffic recently <br />and needs to be reestablished so that coal from the stockpile will not be washed down <br />the undisturbed hillside. <br />The collection ditch below the coal stockpile and loadout bench which routes runoff <br />to the Zower sediment pond~has filled in with sediment in the area where the ditch gradient <br />is fairly Level. This portion of the ditch needs to be cleaned out and the ditch regraded <br />such that there will be a constant gradient between the inlet end of the ditch and the <br />discharge point at the sediment pond. Hopefully, this will eliminate low spots in the ditch <br />where sediments collect instead of being routed to the sediment pond impoundment area. <br />The berm running along the edge of the coal stockpile and loadout bench has breached <br />in one area and needs to be reestablished so that runoff will be routed to the two <br />designed drainage channels that carry runoff to the collection ditch below. <br />The outlet end of the sediment pond dewatering device is clogged and needs to be <br />cleaned out so that it will function as designed. <br />4.15 Revegetation <br />Revegetation on the upper diversion ditch, lower collection ditch, and topsoil <br />stockpile looks good, except for some fairly heavy grazing pressure from cattle. Zf <br />this grazing reaches a point where revegetation success is being hindered, the operator <br />will need to devise some means to keep cattle away from revegetated areas. This may involve <br />fencing or working out some arrangement with the rancher to keep cows away From the area. <br />
