Long, <br />Orv~sion Director <br />On April 9, 1992 we conducted an inspection of the 23 Road Pit and found: <br />(1) No identifable boundary markers for the affected area 121 disturbed area <br />associated with a scale and scale house outside the approved permit area and 13) a <br />portioJ~ of the permit area occupied by Mesa Rock, a marketing operation intended <br />by the owner to occupy that area indefinitely, which is not covered by the <br />approved reclamation plan and does not conform with the approved post-mining <br />land use. <br />We believe there are violations of: 11) Rule 6.7 of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board, 12) Section 34-32-116 <br />17)Ih) and (3-, Section 34-32-112(3) and, by reference, Section 34-32-116(7) as <br />well as Section 34-32-12416) of the Colorado Mined Land Reclamation Act <br />34-32-101 et seg. C.R.S. 1973 as amended, respectively. <br />Therefore, we have found reason to believe violations exist to Permit M-79-089 <br />and the Law and have scheduled this matter before the Mined Land Reclamation <br />Board. <br />A Formal Public Hearing will be held during the August 26-27, 1992 Board meeting <br />far consideration of possible violation. The hearing will be held in Room 318 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon <br />thereafter as the matter can be considered and you will have the opportunity to be <br />represented and heard. it will be reiterated that there is reason to believe that you <br />are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a cease and desist order, <br />assess a civil penalty in the amount of 5100.00 to 51,000.00 for each day of <br />violation or order the permit be suspended, modified or revoked.
