Cottony <br />PO BOX 772 Division Director <br />PhllOmath, OR 97370 Natural Resource Trustee <br />Re: Ophir Lode, Permit M-2001-063, Corrective Actions for Problems Noted in 7/3/06 Inspection. <br />Dear Mr. Giesy, <br />Thank you for the letter received here on September 9, 2006, in response to the problems outlined in the recent <br />inspection report. <br />In your letter you described the information to be contained on the new permit ID sign to be posted at the site. That <br />information includes some, but not all, the information required by the rules. Hard Rock and Metals Rule 3.1.12(1) <br />concerns permit identification signs. It states that the sign must be posted at the entrance to the site and be clearly <br />visible from the access road. It must contain the following information: the name of the operator, a statement that a <br />reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board, and the <br />permit number. <br />The markers to be placed must be more than "stakes." According to Rule 3.1.12(2) they must be clearly visible and <br />adequate to delineate the boundary. They should be durable so they do not require replacement frequently. You <br />may propose a method of marking the boundaries, but as mentioned in the inspection report, it is recommended that <br />the boundary be marked at more than just the comers. Please let us know what method you think is best there, and <br />send a map showing where the markers will be placed. You had asked for extra time in which to install the <br />markers, and I have approved that extension until July 31, 2007. <br />If you need a set of the Hard Rock Rules and Regulations, a "paper" set may be ordered from our Denver office <br />(see letterhead address, above), or may be accessed and/or downloaded from our website: www.minine.state.co.us. <br />Click on "Rules and Regs" (left side), then scroll down on the next page to "Hard Rock/Metal Mines" to the correct <br />document.
