III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of CDMG. This former underground <br />mine is reclaimed. Remaining buildings and structures are approved to remain as permanent <br />structures. The site received a reported 1.5 feet of snow during the late March regional blizzard. <br />Most of the snow cover had melted in sunny areas. The weather was cool and breezy. Mr luppa, <br />the landowner, was present during the initial portion of the inspection. <br />Availability of Records <br />The public copy of the mine records is kept at the Las Animas County Clerk and Recorders ONice <br />at the county courthouse in Trinidad. Although the majority of records were found current through <br />the fourth quarter of 2002, some historic records were not located. They are as follows; <br />• DMG Inspections for the months 7/01, 8101, 7/02, 9102 through 12102, and 2/03 <br />• Discharge monitoring reports 2"° Q 2001, 2rtl O 2002 through 4'" O 2002 <br />• Pond1RDA inspections 2"° O 2001 and 3`d O 2002 <br />Please ensure these historic records are included with the public copy of the mine records prior to <br />the next State complete inspection. Details of the records review are noted on page 2a of this <br />report. <br />Hvdroloaic Balance <br />The south end of the pond that was cleaned of sediment was holding water but well below the <br />discharge point. The trash rack on the riser pipe has been secured with rebar as shown in the <br />accompanying photograph. Ditches and culverts site-wide appeared functional. <br />
