On May 31, 2001, a 93 CFR 3809 <br />field compliance inspection was conducted on the above mentioned mining plan <br />of operations (see attached report). As in previous reports, the inspection <br />found various unused and unnecessary equipment being stored on public land. <br />Given the present condition of said equipment, it is quite apparent that they <br />have not been used in the operation on your project for many, many years. <br />At 93 CFR Sec. 3609.924(2) under the existing regulations, implemented January <br />20, 2001, it states that: <br />If the period of non-operation is likely to cause unnecessary or undue <br />degradation, then BLM will require you to take all necessary actions to <br />assure that unnecessary or undue degradation does not occur, including <br />requiring you, after an extended period of non-operation for other than <br />seasonal operations, to remove all structures, equipment, and other <br />facilities and reclaim the project area. <br />Under the previous 93 CFR 3809 regulations at 38u9-7, it states chat: <br />All operators shall maintain the site, structures, and other facilities <br />of the operations in a safe and clean condition during any non-operating <br />periods. All operators may be required, after an extended period of <br />non-operation for other than seasonal operations, to remove all <br />structures, equipment, and other facilities and reclaim the site of <br />operations, unless he/she receives permission, in writing, form the <br />authorized officer to do otherwise. <br />Because you are not using this equipment in question, you are hereby required <br />to comply with the 93 CFR 3809 regulations and remove this unused, unnecessary <br />equipment. Specifically the dismantled track-hoe, the small bulldozer, the <br />road scraper, the dump truck, the camp trailer, the elevated and non-elevated <br />storage containers and structures, and all miscellaneous materials, refuse, <br />and debris. However, you are instructed not to disturb the historic wooden <br />placer processing facility. <br />
