Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are identified below. <br />Signs and Markers (4.02) <br />1. Upon permit issuance, boundary markers should be installed to <br />delineate the approved surface disturbance boundaries. <br />Hydrologic Balance (4.05) <br />1. During the fall of 1983, Grand Mesa reported discharges which <br />exceeded NPDES limitations for suspended solids and oil and grease. <br />Subsequently, the Health Department inspected the site and, at their <br />recommendation, a 45° elbow was attached to the pond side of the <br />discharge pipe to act as an oil and grease skimmer. <br />A stipulation will be attached to the permanent program permit <br />which will require the operator to document that the existing sediment <br />pond is designed to provide sufficient capacity and detention time for <br />surface runoff and mine water discharge or provide for appropriate <br />modification. <br />The. pond was being dewatered at the time of the inspection, <br />and the water appeared relatively clear. <br />Underground Development Waste (4.09) <br />1. Grading and compaction of waste was completed in July, 1983 <br />and a Quarterly Certified Refuse Inspection was submitted to the Division <br />in October, 1983. The Division requested additional material testing <br />results in order to evaluate the adequacy of the compaction achieved. <br />Additional information was submitted to the Division on January 13, 1964. <br />The Division has not yet completed its determination regarding <br />the adequacy of the reported compaction values. <br />2. The operator indicated that a portion of the covered waste had <br />been reseeded but the job had not been completed due to snow. The <br />remainder of the area is to be reseeded and mulched as soon as conditions <br />allow, and prior to April 15, 1984. <br />
