III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />Carry over items from previous inspections included the following items: <br />• Missing documents on file at the Routt County Court House. Documents were not checked during <br />this inspection. During the Coal Complete Division inspection of July 13, 2004, the following <br />documents were missing: Colorado Division of Minerals and Geology (Division) Permit (Mining <br />Permit -Coal) C-1980-001 (the findings document in support of the decision to renew the permit was <br />on file}; the Routt County Special Use Permit(s) [reference page 2.03-37 of the Pennit Application <br />Package (PAP)]; the report of the June 2004 Division inspection, and the 4"' Quarter 2003 and 1 s' <br />Quarter 2004 quarterly pond inspection reports. The operator reported that these documents were now <br />on file. <br />• The mine and permit identification sign on the Skyline access road (Routt County Road 44Z) from <br />Routt County Road 27 had not been refurbished (deterioration first noted during the July 13, 2004 <br />inspection). See the discussion under Signs and Markers below. <br />• Maintenance work had been not been accomplished on Check Dams 17 and 21, or on erosional <br />features, as scheduled in the Edna Mine 2004 Erosion Inventory Report (July 2004). Erosional features <br />have been corrected. See the discussion under Slides and Damage below. <br />• Terrace T-7 had filled in from sediment from the roadway, and terrace flow had overtopping the rim <br />of the terrace. Maintenance has been accomplished. See the discussion under Slides and Damage <br />below. <br />• Terrace T-] 1 has filled in with sheet erosion sediment from a reach above. Terrace and sheet flow <br />had eroded the Terrace T-11 fill. This erosion was first detected and reported in the Division Inspection <br />of June 2, 2004, and had reached six feet in depth in some places. Maintenance has been accomplished. <br />See the discussion under Slides and Damage below. <br />Signs and Markers <br />The identification number of the current permit on the sign on the Skyline access road (Routt County <br />Road 44Z} from Routt County Road 27 is still nearly illegible [Rule 4.02.2(2}], <br />Roads <br />Sections of roads had been graded and road ditches had been cleaned and re-shaped about the site. <br />Hydrologic Balance <br />November 75, 2004, page 3 of 6 pages, BGW <br />
