III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a combination complete and Phase 1 bond release inspection. DMG inspectors <br />included H. Ranney, D. Hernandez, and S. Shuey. Mine personnel on site for the inspection <br />included R. Gubka and T. LeFre. Mel Staats, Montrose County Commissioner and land owner <br />was also present for the bond release inspection. <br />Phase 1 Inspection: The main areas of concern that were inspected included approximate <br />original contour, drainage reconstruction and satisfaction of DMG rules for bond compliance. <br />The entire Phase 1 bond release area was walked and with only one small depression, the site <br />totally complied with the AOC rule. Mel Statts expressed concerns that his prime farmland area <br />had numerous small depressions that inhibit efficient haying operations after vegetation was <br />established. The mine agreed to float the area with a land plane to alleviate this problem. All <br />drainages that were affected by mining operations have been reconstructed to designed <br />specifications. No problems were noted at the "Rice Traci" area. More information concerning <br />the bond release can be found in the Findings Document for the Phase 1 Bond Release. <br />The complete inspection for the remainder of the site included the inspection of all ditches, <br />culverts, and ponds. All structures were in compliance and were capable of functioning as <br />designed. Ponds 1, 6, & 7 had water in them but only pond 1 was discharging as is does on a <br />continual basis. Ponds 2, 3, 4, & % were dry. <br />Topsoil depths were spot checked and for areas with a 12" required depth, the average depth <br />was 13.25" and for the 18" areas, the average depth was 17.8.", see accompanying map. <br />Records were inspected and found to be in compliance, see pg. 5 of this report for further <br />information. <br />The irrigation season had just started and the mine plans to use side rolls and pivot guns on the <br />reclaimed areas to establish a good stand of vegetation. <br />
