<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A partial inspection of the Canadian Strip mine was conducted by <br />Christine Johnston of the Division. The weather during the <br />inspection was clear, cool and breezy. There were patches of wind <br />blown snow on the site. <br />AVAILABILITY OF RECORDS <br />The following records for the mine were reviewed at the county <br />courthouse in Walden: <br />DMG Permit Expires December 1, 1996 <br />Insurance Certificate Period of coverage 6/17/94-7/1/95 <br />Bond Document Letter of Credit for $235,132.00 <br />Phase I Bond Release On file - submitted 12/18/87 <br />Application <br />Phase I Bond Release On file - dated 12/22/88 <br />Findings <br />Phase II Bond Release Applicatio n on file <br />Application <br />Phase II Bond Release On file - final Division approval <br />Findings dated 9/29/92 <br />2nd Qtr. 1994 DMR On file - no discharge reported for <br /> 001, 002, or 003 <br />Previously, a violation (NOV C-94-026) was written for failure to <br />retain copies of all required records. The operator transmitted <br />all the above to the courthouse with a cover letter dated October <br />6, 1994. The Phase II Bond Release application was not found among <br />the mine records. The operator should forward this to the county <br />courthouse as soon as possible to abate the violation in a timely <br />manner. <br />HYDROLOGIC BALANCE <br />Pond #2 had a small amount of water. The rock blind constructed in <br />the emergency spillway had been removed. The work required by NOV <br />C-94-024, with the exception of removing the plastic sheeting and <br />overgrown vegetation from inside the primary spillway and at the <br />outlet end, respectively, has not been done. It appears that the <br />embankment has been surveyed and staked. <br />There are settling cracks in the inslope of the Pond ~2 embankment. <br />The cracks are in the north facing embankment at the opposite end <br />of the emergency spillway. I am not sure if these cracks are <br />related to instability of the embankment or are settling cracks. <br />This area should be watched during future inspections. <br />
