III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on October 30, 2000 by Harry Ranney of the Colorado Division <br />of Minerals and Geology. The digital images were reviewed on November 6, 2000 by Joe <br />Dudash of the Colorado Division of binerals and Geology. No compliance problems were <br />observed during the overflight. <br />Hydroloey <br />There was a small amount of water in pond B. The guard rail has not been installed yet between <br />pond B and highway 133. Pond D was dry. The water level in pond C was past the level of the <br />primary discharge tube but only by a couple of feet. Pond inslopes and outslopes appeared to be <br />erosionally and geo-technically stable. There were no signs of erosional problems at the mine. <br />Facilities <br />The operator continues to construct the downhill conveyor and loadout system. Coal is being <br />stockpiled on the southern end of the coal stockpile bench between the stacker tubes and the <br />bench edge. No problems with fugitive dust were observed. There were no problems observed at <br />the portal bench. The coal stockpile on the portal bench was at its lateral limits. No problems <br />with fugitive dust or coal dust on the portal bench outslope were observed. There were no <br />problems at the material storage areas. <br />Roads <br />The main haul road was in very good condition. The haul road to the gob pile was in good <br />condition. The access road from the portal bench to the water tank bench was in good condition <br />as well. <br />Topsoil Stockpile <br />There were no signs of erosional gullying on the main topsoil stockpile. The collection ditch was <br />functional. <br />Geo-technical Stabilitv <br />There were no signs of geo-technical instability at any of the cut and fill slopes. The previous <br />slide areas behind the wazehouse and above the portals appeared to be stable. <br />Gob Pile <br />The operator has spread out the small refuse piles that had been placed on top of the gob pile. No <br />ponding of water was seen on top of the refuse pile. The upland diversion ditch appeared to be <br />functional. <br />c:\ms97\bow ie2\i nsp 10106 <br />
