<br />111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the King Coal Mine for the month of January, 1996. <br />The site was covered with approximately 12" of snow. <br />The slopes appear to be stable under the snow cover. <br />The facilities area is clean and in good shape. <br />The old transformers that split power to the facilities and underground have been replaced by a <br />larger transformer which directs full power underground to reach further back. The new <br />transformer is positioned just south of the portals, near the power pole. <br />The stoker coal bin still has not been constructed though the materials were acquired months <br />ago. In fact, a pile of mine waste has been piled in the spot designated for the new bin. This <br />area will need to be cleared of the waste material and the bin constructed in a manner to contain <br />the oil sprayed on the stoker coal. The containment should be adequate to prevent infiltration <br />into the ground and to prevent precipitation from washing the oil into the sediment control <br />system for the mine. A large flush of this material into the sediment ponds may render the pond <br />cleanings unusable for a plant growth medium. Additionally, the ponds do not have oil booms <br />placed to intercept and soak up any oil that may find its way to the pond. This situation has <br />been a problem for over a year now. The obvious lack of cooperation is disturbing. Therefore, <br />this situation must be adequately resolved by the time of the March Division inspection to avoid <br />action being taken. <br />
