III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDRMS. The Grassy Gap mine is a reclaimed <br />surface mine. The mine permit and reclamation liability bond have been revoked by DRMS.. The weather has <br />been very dry in the area. <br />On June 19, 2007, DRMS notified the property owners, Cross Mountain Ranch, that the inspector would be on-site <br />to conduct an inspection. Cattle were grazing along the access road at the intersection of the Pit 4 access road, <br />along the access road, at the intersection with the Pit 2/3 access road and at the Pit 5 pond embankment. The total <br />number of observed cattle was about 100 head. An aggressive bull impeded access to Pits 2& 3. Pits 2 & 3 were <br />observed via binoculars from other portions of the mine. <br />Hvdroloeic Balance: Pit 5 spoil spring flow was flowing slowly. The Pit 5 pond is stagnant and full of algal <br />growth. Pond 4 was holding a small pool of water several feet below the outlet elevation. Waterfowl were utilizing <br />Pond 4. Grassy Creek is flowing. The natural spring along access road was flowing. <br />Reve ete anon: It appeared that cattle had not been on the site for long. Little grazing of the pits had occurred. <br />Vegetation was in good condition. Few noxious weeds were observed. Some minor gullying was noted on the <br />N W extreme of Pit 3. No sheep were on the site yet. <br />Slides: The old slide scar below has healed itself and is well vegetated. No evidence of recent slide <br />movement was discernable. <br />Reclamation Success: DRMS collected vegetative data in 2005 and 2006. Unfortunately, grazing had <br />occun•ed prior and during data collection. The Division is tabulating the data to determine vegetative <br />success. <br />
