The operator Mrs. <br />Jarldine Thornburg contacted) the Division and requested a site inspection to make sure that the County who is <br />operating the site under their permit does not affect areas more than covered by the financial warranty. The <br />current warranty for the site according to DMG record is $14,000.00. However, the operators seem to believe <br />the actual warranty for site tobe $37,000.00 and provided a copy of a cooperate surety showing the larger <br />amount. The site is permitted to affect a total of 53 acres of the total permitted acres of 77.94 acres. <br />At the time of the inspection approximately 4.5 acres appeared to have been affected. The operator with out <br />exceeding the warranty, even if it is $14,000.00 until resolved, can still affect an additional 4 acres with out the <br />need for an additional warranty. In addition since the mining is taking place at an approximate slope of 2.5: 1, <br />the operator has an option torequest a warranty reduction for the backfill and grading in the areas where <br />mining has been completed so the warranty can be applied to areas to be affected in the future.
