III. COMMENTS -COMPLIANCE <br />This was a partial inspection conducted by Jim Burnell of CDRMS on the afternoon of <br />Wednesday, 11 October 2006, accompanied by Henry Barbe of Mountain Coal Company. <br />The site was very muddy from abundant recent rain. Site was active. Stockpiles were very <br />large, a result of a paucity of recent trains. <br />The signs were posted appropriately and correctly at the mine entrance and at all topsoil <br />piles noted and at the stream buffer areas. <br />Roads were muddy but in good condition. Work has started on the Sylvester Gulch road; <br />brush was cut along the road corridor in preparation for widening of that road (covered by <br />TR-99). No excavation had taken place yet. <br />Pond SG-1 was pretty full with turbid water. Level was still below maximum to maintain <br />capacity but it should be monitored. Sylvester Gulch was running strong with turbid water <br />also. <br />The topsoil piles were stable and well vegetated. That includes the NSSA topsoil piles (north <br />soil storage area) on the north side of the highway. <br />The LRP (lower refuse pile) was stable. The top was covered with equipment and supplies <br />as usual. The refuse pile expansion (RPE) was stable also. There was a good bit of recent <br />refuse there. Compaction tests had been conducted the previous week. <br />Overall, the mine site was in good condition with no regulatory issues. <br />
