Box 102 <br />Castle Rock, Colorado 80104 <br />RE: The Snowstrrm Placer Mine <br />Ted Zigan, pperator <br />MLRD Permit No. M-83-84 <br />Sections 19, 20, 29, and 30, T9S, R771J <br />Park County, Colorado <br />Dear Ms. Gottert and Mr. Krause: <br />On October 6, 1988, the Division received your letter regarding the legality <br />of this operation. You requested information on the operation and reclamation <br />requirements of the activity. You expressed a complaint as to the ambient <br />fugitive dust and excessive noise being caused by the operator. You expressed <br />concern about a possible discharging of an unknown waste into the South Platte <br />River via a PVC pipe leading from the operation. You expressed concern about <br />a twenty-foot tall overburden stockpile being created by the operation in the <br />northern portion of the southeast quarter of Section 19 in that the stockpile <br />was burying forest vegetation and encroaching onto your property situated <br />north of the operation. <br />Our files indicate that this is a legally permitted open pit sand, gravel, <br />gold, and silver mine. The permitted operator is Ted Zigan, the name of the <br />pit is the Snowstorm Placer, and the MLRD Permit Number is M-83-84. It is <br />permitted for 200 acres and is currently bonded for reclamation purposes with <br />an E11,022.00 financial warranty. <br />I have enclosed copies of the mining and reclamation plans submitted as part <br />of the application, as well as copies of pertinent correspondence. This <br />information should address your inquiry for information on scope, operating <br />regulations, and reclamation requirements, I would recommend you also <br />purchase from our Division a copy of the Mineral Rules and Regulations, <br />available for X2.00 payable to the MLRD. This will provide you with the <br />statutes governing mining and reclamation permits in Colorado. <br />The burying of forest re vegetation as part of the mining operation within the <br />approved permit boundaries has been previously approved as the operator has <br />provided a plan to replenish this disturbance (see reclamation plans). <br />Complaints about noise should be addressed to your local municipal and county <br />government planning departments.
