III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments in Section IV describe any enforcement actions <br />taken during the inspection and the facts or evidence supporting the enforcement action. <br />Notes: The bridges are in disrepair. A reduced level of maintenance, sufficient for foot <br />traffic, has been approved. The Portal 3 area, treatment ponds, and pond P-9 have <br />been identified as a alternative land use. <br />Items of interest from the previous inspections included a number of records. Records <br />were not checked during this inspection. <br />A number of pictures were taken during this inspection and are on file at the Division. <br />Copies of the photographs were mailed to the Operator along with this inspection <br />report. <br />SIGNS AND MARKERS The permittee sign at the fan shaft road still needs to be <br />replaced. <br />ROADS The culvert under Pitkin County Road 1 (Portal 1) was approximately half (24") <br />full of sediment. It is designed to handle the required flow at a sediment depth of <br />25.5". <br />HYDROLOGIC BALANCE There was water discharge from both the mine drains into <br />the long pond, which then flowed into Treatment Ponds 1 and 2. The water treatment <br />system was in proper operation, Water was not being pumped by the landowner <br />from Pond 2 to an off-site stock tank. There was no flow to Pond 9. The discharge at <br />CPDES point 001 was 5 gallons per 15 seconds (20 gallons per minute). <br />BACKFILL & GRADING (and DEMOLITION) A Phase I Bond Release (for backfill and <br />grading) was approved for the site.
