Mr. Stockwell is concerned about the storage of the explosives, chemicals and fuels on his <br />property. Robinson may use explosives for this mine. These items will create a hazard For Mr. Stockwell's cattle, <br />as well as a hazard to any wildlife on Mr. Stockwell's property. The storage of chemicals and fuel on Mr. <br />Stockwell's property also raises potential CERCLA issues. Has Robinson addressed those issues? Mr. Stockwell <br />does not want any disposal of waste or storage of petroleum products or hazardous substances on his property." <br />The storage of explosives on the property and the safety issues involved are more properly addressed by <br />the Mine Safety and Health Administration. However, once this issue is addressed, Robco would be <br />required to modify their permit to allow storage of explosives on site so that the DMG could include the <br />cost to reclaim the storage area into the reclamation bond. When (and if) Robco decides to use <br />explosives on site they will be required to specify the blasting plan for the site so DMG can review it to <br />ensure that buildings and other manmade structures are adequately protected. <br />No chemicals are stored on site. <br />Fuels used on site are, at this time, brought in on fuel trucks or trailers that are not considered to be a <br />hazard since they are on site for such a short period. The permit requires that, if fuel is permanently <br />stored on site, a containment area large enough to hold the entire volume of fuel will be constructed. If <br />fuel is inadvertently spilled within the permit area, the DMG requires operators to clean up the spill to <br />standards that are as stringent as standards used by the Colorado Department of Public Health and <br />Environment's Hazardous Waste Section. <br />The permit also requires that "All refuse or acid forming toxic materials that have been used will be <br />disposed of off site at an appropriate location or public landfill."(see page 16, Exhibit E). <br />6. Comment: "The new mining proposed on the NE'/a of Section 16 will create a larger eyesore to this area <br />because the new mine will be higher on the Hogback and even a more visible scar on the land." <br />The Colorado Land Reclamation Act for the Extraction of Construction Materials provides no authority to <br />regulate visual impacts of mining and this aspect is therefore not under the jurisdiction of the DMG. This <br />concern may be more appropriately addressed via the Jefferson County Special Use Permit. <br />Comment: "... Mr. Stockwell is concerned that Robinson may not have complied with all of the necessary permit <br />requirements for Jefferson County," <br />The DMG cannot enforce or address items contained in another agency's permit, The landowner is <br />advised to contact Jefferson County concerning compliance with County permit requirementr. <br />8. Comment: Mr. Stockwell is concerned with potential mine drainage problems on his property. Specifically, <br />Robinson has a mining permit for the unrelated Hogback Mine which is located south of Mr. Stockwell's property. <br />From the Hogback Mine there has been acidic mine drainage into the High Line Canal. The Hogback Mine is <br />mined and the Stockwell property will be mined from the same rock formation which has the potential for forming <br />acidic mine drainage. Mr. Stockwell is concerned that no drainage permit exists since the potential exists for <br />acidic mine drainage if the mine discharges water." <br />During this inspection a pond was observed at the base of the highwall in the active mine area. This <br />pond has apparently been in place for quite some time since cattails were observed growing along the <br />east edge of the pond. The pond was sampled for pH with a pH meter supplied by the operator..The pH <br />measured was approximately 8.6 and mud puppies (salamanders) and fish (probably bluegills) were <br />
