<br />III. Comments -Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection, comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />On July 24, 1992 a complete inspection was conducted at the O.C. Mine No.2. At <br />the time of the inspection a mine representative was not present, however Bob <br />Sdeaver was met in Gunnison for the records check. Phis mine is in temporary <br />cessation. It wss thundering and lightning with a heavy downpour at the mine <br />site. <br />The ditches were observed to be flowing and working effectively. The pond ~.-as <br />mostly dry with small puddles of wstex• in the bottom. The ditch serving the coal <br />storage pad needs routine maintenance. TT~is should be cleaned when possible <br />before the design capacity is lost and the condition becomes a violation. Recent <br />heavy rains have covered the bottom of the ditch with coal fine sediment. <br />Mr. Robert Weaver, the operator, was met in Gunnison where the records were <br />checked. All records were in order. Mr. Weaver was given a copy of the <br />Division's bond calculations. The Division, using a computer program specifically <br />developed for the purpose, calculated that the bond liability to be 360,000, lle <br />was informed of several options that could be taken: <br />1) that the bond amount would have to be increased to $60,000 or, <br />2) the liabilit, could be decreased b,y the removal of surface structures or, <br />3) a demonstration that the Division's bonding calculations ax•e inaccux•ate <br />and supply the Division with more accurate numbers. <br />The entx•ance to the mine was closed with a strand of barbed wire. <br />
