<br />III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of <br />Minerals and Geology. No one else was present during the field portion of the <br />inspection. The ground was dry. The entrance gates to the loadout were locked <br />AVAILABILITY OF RECORDS <br />The records checklist ~s attached. <br />SIGNS AND MARKERS <br />The mine i.d. sign displayed at the entrance gate needs updating with the permittee's <br />correct address and phone number. The permittee's representative said by phone that those <br />changes are in progress. <br />Permit perimeter signs, stream buffer signs, and topsoil markers were properly displayed <br />ROADS <br />The Tie-across Haul Road is in good shape. The access road in the office area and Haul <br />Roads 1 and 2 are in good condition. <br />HYDROLOGIC BALANCE <br />Ditches - The following ditches appeared to have design capacity: the perimeter ditch <br />and collection ditches ~n the truck loop area, ditch 7, and the ditches beneath the <br />conveyor where the sump pump drains. The west end of Ditch 9 (at the entrance gate) <br />needs cleaning as a result of recent snow plowing partially filling it gyn. The ditch is <br />capable of functioning, though, The operator's representative, John Weinman, was <br />contacted by phone and said the ditch will be cleaned out. <br />Culverts - Culverts beneath the conveyor (LFC-3. 4, and 5) were in good repair at their <br />inlet and outlet ends and were clear. Culverts LFC-1 and LFC-9 are clear and display no <br />scouring at either end. <br />Sediment Control Ponds - The water level in the truck loop pond (Pond 1) is approximately <br />1 foot below the top of the drop inlet. The water level in the rail loop pond was <br />approximately two feet below the invert of the trapezoidal spillway. Both ponds' inslopes. <br />outslopes, and embankments appear stable. and are not Bullied. Straw mulch ~s in place <br />on the embankment of the rail loop pond from last year's work. There was not yet a sign <br />of seed germinating on the embankment. The banks of the rail loop pond were covered in <br />places with a white salt precipitate not previously noticed here. (The perimeter ditch <br />next to the Tie-Across Haul Road also had this precipitate ~n ~t.) The precipitate <br />appeared to be of natural origin as it was spotted at numerous locations in the Dry Creek <br />Valley outside the permit area. <br />Dry Creek - The channel of Dry Creek was flowing roughly three-quarters full. Stream <br />buffer signs are leaning over and need to be placed upright. <br />Page 3 <br />
