(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn_~pps_nen <br />INSPECTION DATE: Mn~23 2f~.5 INSPECTOR=S INITIALS ~_ <br />OBSERVATIONS <br />This inspection was conducted in response to a complaint received at the Division via fax on May 19, 2005. The <br />focus of the complaint is a small sub-division on the south side of the town of Alma. The complainant expressed <br />a concern that mining appeared to be occurring within the sub-division as a screening plant had been on site <br />to process some of the cut and fill material into road base and in addition, excess and oversized material was <br />being removed from the site in trucks. Furthermore dust and noise were a nuisance problem associated with <br />the construction activities. <br />Upon arriving at the location it was evident that a significant cut and fill had occurred 6s the result of the <br />construction project that is underway. It was also evident that material had been processed, as a large <br />site and was in fact occurring during the inspection. Upon questioning the earthmoving sub-contractor, Jeff <br />Carnahan, he was very upfront about what activities were occurring on site and had occurred over the past <br />couple of weeks. Mr. Carnahan stated that he was responsible for the earthmoving contract for this site <br />including a significant cut and fill to create a level building area for a series of small tract homes. He also <br />indicated that he had conducted screening operations of suitable excavated material in order to obtain <br />enough road base to surface the main road that is platted through the sub-division. Furthermore, Mr. <br />Carnahan stated that he had removed many truckloads of excess material, primarily over-sized rocks and <br />boulders, to his construction yard located near Fairplay. <br />The general contractor is Doug Snyder of Snyder Construction. Mr. Snyder indicated that he did have an <br />approved permit with the town of Alma to proceed on the Angel Fire Subdivision and that the permit did <br />require his company to stabilize the cut and fill area created to facilitate construction of the homes. This was <br />confirmed with the Town of Alma, although the town representative indicated that the permitting language <br />was pretty loose with respect to events that have been occurring on site. It is also obvious that construction is <br />moving forward as several foundations have been poured and the final lay-out of the site is beginning to take <br />shape <br />It is also obvious from this inspection that mining type activities have occurred on this site, however, in <br />accordance with the Mined Land Reclamation Board's policy for "Need for a Reclamation Permit" this activity <br />would be exempt from the need to obtain a permit under item three of that policy which states, <br />"The excavation of material is part of a project that is subject to government review and permitting. The <br />approved government permits ensure a beneficial use of the site affected by the material extraction. The <br />intended off site use of the extracted material is clearly incidental to the project." <br />Therefore, based on this inspection, the activities occurring on this site would not require a reclamation permit. <br />Although DMG is not requiring a permit, it was suggested that the operator should conduct dust suppression <br />activities and try to reduce the noise as much as possible and backfill the cut-slope to at least 2H:1 V prior to <br />conducting revegetation efforts.
