~_ <br />Minesite Evaluation Report Narrative <br />Terror Creek Loadout <br />Personnel: Donna Griffin, OSM <br />Rick Chilton, Company <br />This was a complete inspection of the Terror Creek Loadout <br />facility, along with a follow-up of Ten-Day Notice (TDN) <br />#84-2-244-4. <br />TDN #84-2-244-4 was written to address a 0.7 acre storage yard <br />where the topsoil had not been salvaged and stockpiled. At the <br />time o£ this inspection, several piles of wood and some used <br />belts were stored in the area. The company was keeping the area <br />mowed and there was good vegetative cover. There was some <br />contamination of soil in that as the front end loader removed the <br />rolls of belts from the active area a small amount of coal was <br />also picked up and deposited on the topsoil in the storage yard. <br />Upon return to the site office a written variance was found and <br />reviewed. OSM was in error issuing TDN 84-2-244-4 as a written <br />variance constitutes a permit document and the operator was <br />complying with his approved permit. OSM's position that there <br />was no basis for the issuance of this variance is a matter for <br />programmatic analysis, not field application. <br />The remainder of the inspection produced no further problems. <br />Drainage is controlled by ditches and berms directing drainage to <br />a pond. Topsoil is stockpiled and vegetated. Section 25, <br />Performance standards, Code 3 indicate the performance standards <br />that will never occur at this site. Several standards, such as <br />backfilling and grading and revegetation have not occurred, but <br />of course, will occur in the future. <br />
