Reduced Insp ection Freq uency Checklist <br /> <br />MINE: Fruita #1 and #2 MINE ID: C-81-015 <br />COUNTY: Mesa TYPE: Und./Private. <br />OPERATOR: N/A (Revoked) INSPECTOR: Dan Mathews <br />(i) How the site meets each of the criteria under the definition <br />of an abandoned site under Rule 1.04(1) and thereby qualifies for <br />a reduction in inspection frequency. <br />The Fruita No. 1 and No. 2 Mine qualifies as an "Abandoned Site", <br />pursuant to Rule 1.04(1), based on the following: <br />(a) All surface and underground coal mining and reclamation <br />activities of the operator at the site have ceased; <br />(b) The Division has issued at least one notice of violation <br />or cessation order, and the notice progressed to a failure-to-abate <br />cessation order; <br />(c) The Division has taken action to ensure that the <br />permittee and operator, American Shield Coal Company, and owners <br />and controllers of the permittee and operator, have been precluded <br />from receiving future permits; and, has, after evaluating the <br />circumstances, concluded that further enforcement offers little or <br />no likelihood of successfully compelling abatement or recovering <br />any further reclamation costs; and <br />(d) The Division has forfeited the available performance <br />bond. <br />Date Permit Revoked and Bond Forfeited: <br />Bond Money Held by the Division: 528.349.00 <br />
