III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the
inspection and the facts or evidence supporting the enforcement action.
This was a complete quarterly inspection of the reclaimed bond
forfeiture site. Weather was cloudy and cool, and the site was
muddy in most areas, with patchy snow cover in shaded locations.
The primary purpose of this inspection was to comply with
regulatory requirements to allow for a reduced inspection
frequency, pursuant to Rule 5.02.2(8).
Site conditions have not changed appreciably in recent months.
Despite recent precipitation, the sediment pond contained no
standing water.
The Division will erect a sign at the site when it is next
inspected, to direct interested persons to DMG.
Detailed inspection comments are contained within the attached
"Reduced Inspection Frequency Checklist", which is a part of this
inspection report.
This report, along with the Division's "Proposed Decision and
Written Findings for Reduced Inspection Frequency", will be placed
on File with the Mesa County Clerk, for public review. Certain
records, along with a public notice advising interested persons to
contact the Division for further information regarding coal mines
in Mesa County, are also on file at this location.
The Division is proposing an inspection frequency of four complete
inspections per year, one per quarter.
