i <br />Z <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the faces or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear <br />represented the operator. There had been a rain event the night before the inspection. <br />Train Loadout <br />Work continues on the train Loadout construction project. The main line bench and track work <br />have been completed. The spur lines aze being constructed. The east spur line bench has been <br />completed and the track work is being laid. Most of the work on the conveyor system, transfer <br />tower and loading tower is done. The belt is onsite but not installed yet. Ballast is being placed <br />on the spur line tracks in the west and central portions of the construction area. There was very <br />little water in both Pond J and Pond K. Silt fence has been added to the bottom of the pond <br />outslope for Pond K. <br />The operator encountered a seep from water that is leaking from the Fire Mountain Canal that <br />lies above the track work. The seep is occurring on the upper main track bench cut slope and in <br />the lower spur line cut bench slope. Repairs were made to the canal but some water is still <br />getting through. A french drain was built on the lower spur line bench to drain the canal seep <br />water offsite. The canal water has been stopped until next yeaz. The operator will continue to <br />make repairs on several sections of the Fire Mountain Canal in order to reduce the flow in this <br />area and other areas. The operator has finished the concrete-lined ditch on the east side of the <br />spur line bench. <br />On the west side of the project area, the operator encountered a lot of ground water in building <br />the spur line bench extension. The water was coming from the Fire Mountain Canal and an <br />adjacent irrigated field. The canal water has been shut off so it will take a few days for the <br />groundwater to percolate through the work azea. The contractor is piping the water that is near- <br />surface underneath the tracks and offsite, Also, french drains have been constructed to drain the <br />groundwater that is deeper in the bench. Finally, the contractor is in the process of buttressing the <br />bench extension. This is being done by excavating in front of the bench extension and adding <br />river gravel as a base, followed by fill. Within the fill will be layers of geo-textile material for <br />added stability. The contractor has constructed a berm to hold back the wet excavation material. <br />However, silt fence needs to be installed for extra protection since the work area is near a <br />wetlands area. <br />c:\ms97\bowie2linsp0802 <br />
