III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />daring the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. <br />Facilities <br />There was a fairly large volume of coal being stockpiled on the west side of the facilities bench. The <br />stockpiled coal was contained by the berm on the edge of the bench. There were loading and unloading <br />activities taking place during the inspection. No signs of offsite fugitive dust were observed. The main <br />paved mine haul road had a little coal dust on it but it was not being tracked onto the main highway. <br />There were no fuel spills at the fuel facility. A moderate amount of coal waste was being stockpiled on <br />the east side of the facilities bench. There were no problems observed at the office/shop area, material <br />storage area and the substation. <br />Hvdrologv <br />The water level in the east pond was about 2 feet below the invert of the primary discharge tube. The <br />gated valve was closed. Pond inslopes were well vegetated. The pond embankment also was well <br />vegetated and appeared to be stable. Pond spillways were functional. The west pond was dry. The silt <br />fence was placed in the pond embankment notch. <br />The straw bales and silt fence were in place along the railroad track SAE. However, the silt fence in <br />the metal plate cutout, located along the tracks just east of the white downdrain pipe of the irrigation <br />ditch, needs maintenance soon. The operator recently did maintenance work on the culvert outlet and <br />ditch at the entrance to the office/shop area. Also, the culvert outlet and ditch that takes the east pond <br />discharge water underneath the side road was recently cleaned. <br />Topsoil Stockpile <br />The south side of the west topsoil stockpile is beginning to show some vegetative cover. The north side <br />of the same stockpile was well vegetated. The collection/diversion berm was functional. The topsoil <br />signs were up. The vegetative cover on the east topsoil stockpile was moderate and the collection and <br />diversion ditches were intact. The topsoil signs were up at this stockpile as well. <br />Signs and Markers <br />Mine ID signs were up at the appropriate locations and contained the correct information. <br />caword/terror/insp 1104 <br />
