We believe we have substantially addressed these issues. This letter <br />intends to update you about these issues on a point-by-point basis. <br />Item 1: <br />Exhibit B, Index Map has been corrected as suggested. <br />Item 2: <br />Table D-t labeling has been corrected as suggested. <br />Item 3: <br />Exhibit E, Reclamation Plan, wording has been changed to reflect comments. <br />Item 4: <br />Acknowledged. <br />Item 5: <br />A new right-to-enter document has been prepared and signed by Mr. McDowell as <br />suggested. Right-to-enter agreements with Western States Power Authority (not Bureau <br />of Reclamation, as previously indicated) and Magpie Operating Company are currently <br />being sought. There is currently same question as to whether the ditch easements on <br />Robert Reichert's property are actually held by an entity separate from the landowner. A <br />title company is currently preparing a statement of opinion on the holder of these <br />easements, if existent.
