III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions taken during the inspection and the facts or evidence supponing [he enforcement action. <br />Jerry Nettleton (Nettleton) of Twentymile Coal Company (Twentymile) accompanied Byron Walker (Walker) <br />of the Colorado Division of Minerals and Geology (Division) during this inspection. After the joint <br />inspection, and as discussed with Nettleton, samples were taken at various locations outside the petmit area <br />from streams in the region and tested for conductivity, pH and temperature by Walker. Results are attached. <br />No new items of concern were identified during this inspection. Items of concern from previous inspections <br />include the following. See discussions regazding these items under inspection topic headings. <br />• Uniformity of mazkers that delineate the perimeters of azeas affected by surface operations or facilities <br />markers [Rule 4.02.1(2)] (in work). <br />• Revision of page 2.03-37 of the Permit Application Package (PAP} to reflect current practices by Routt <br />County (County) with regard to the numbering of County Special Use Permits (prepazed for submission as a <br />Minor Revision). <br />• Clearly indicating boundazies of areas authorized for disturbance on maps of the PAP (in work). <br />• Approved design of the sediment control measure for the temporary belt structure storage azea (in work). <br />Reversion of this area back to a road is one option being considered by the operator. <br />• Approved design of the sediment control measure currently in place for the CYCC office area (in work). <br />• Approved design of the sediment control measure for the "Ttudy's" corner storage and training azea site (in <br />work). <br />• Protection of the topsoil storage pile at the North West Mains Ventilation Shaft (programmed). <br />• Maintenance of the sediment control measure at the # 7 North Escape Shaft (change in work status to <br />scheduled). <br />SIGNS AND MARKERS <br />Markers (Rule 4.02.3) delineating the perimeters of areas affected by surface operations or facilities were in <br />place, but were not of uniform design (or had weathered to the extent that the uniform appearance had been <br />lost)[Rule 4.02.1(2)]. This item was first identified in the inspection of July 12, 2004. An internal decision to <br />mark the tops of markers in place with a common color has been made, but this decision has not been <br />described in the PAP, nor is work underway. <br />ROADS <br />An access road is proposed in Technical Revision 44 to the proposed 18-Right Ventilation Shaft. The route of <br />this proposed access road, a portion currently a dirt two-track road, was followed to within sight of the shaft <br />site. <br />C-1982-056.
