III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the operator <br />during the inspection. <br />Facilities <br />During the inspection, railcars were being loaded. However, no coal haul trucks were unloading coal. Also, <br />there were only two small coal stockpiles on the facilities bench. No fugitive dust was observed going offsite or <br />being tracked onto the highway. There was some coal dust on the ground underneath the overhead conveyor but <br />this area is upgradient of the sediment control structures of straw bales at the railroad small area exemption. <br />Hvdroloev <br />The east side sediment pond did not have any standing water in it, although the bottom of the pond was wet. The <br />pond embankment was well vegetated and appeared to be stable. Pond inslopes were also stable. The discharge <br />structures of the pond were functional, with the gated primary valve in the closed position. The west dugout <br />pond was dry. The pond inslopes were bare since the pond had been recently worked on. The pond outslope did <br />not have much vegetation. The riprapped spillway of the dugout pond was functional. <br />Roads <br />The paved main haul road was in very good condition. Guardrail was up along the road's outer edge. The east <br />side graveled road was in good condition, with the gate left open. <br />Signs and Markers <br />Mine [D signs were up at the main entrance, east entrance and near the railroad tracks. The information on the <br />mine ID signs was correct. The permit boundary marker signs were also up around the site. <br />T~soi1 <br />The west side topsoil stockpile had a good vegetative cover. The collection diversion berm surrounding the pile <br />was functional. The topsoil stockpile sign was up. The east side topsoil stockpile had fair to good vegetative <br />cover. This pile had been recently reseeded. Topsoil stockpile signs were up and the collection and diversion <br />ditches were well vegetated and functional. <br />c: /word/terror/i nsp0706 <br />
