Compliance with Colorado Svr_`ace Coal :4ining Rec_'amat`on act <br />CR5 Z9~3, as amended 3~1-33-101, et. ses., <br />and the <br />Rules and Re?uZations Issuri Rursuanr to .ye act <br />TSis inc-'udes a listing of the oarti cu_'ar provisions of the regulatory program wi:i ch were <br />examined during the course of this inscection, and identifies an:orc=.ment actions tzken <br />during tie Inspection for failure to comply with the Rules and Regu_'a dons, the :,ct and <br />the permit. <br />4.02 Signs and Markers <br />All signs and markers were in good condition and in compliance. <br />4.03 Roads <br />Road surfaces were in good condition. All culverts along the haul road were in <br />good condition and clear. All road embankments had been drill seeded. <br />9.05 Hydrologic Balance <br />Ditches and berms were in good condition. Embankments of all sediment ponds had <br />been reseeded. Ponds A and B contained no water, pond H was holding approximately 50 <br />gallons, basin C was holding approximately 20 gallons. <br />The Division has reviewed the plans and desinn for pond C and is satisfied that <br />it meets permanent program standards. However, as designed, the pond would impound more <br />than 2 acre-feet of water. The operator must obtain the water rights to such water as <br />is impounded and/or provide a means (such as a pump) to dewater the pond to below 2 <br />acre-feet storage. <br />k'ater well levels indicated a 2 inch rise in water level in the P1ann Draw alluvium <br />since September, 1982. <br />9.06 Topsoil <br />Topsoil stock~iZe B and a small area of topsoil stockpile A (on the east edge) <br />are currently being added to. A ditch has been constructed around the active portions <br />of stockpile B. A similar ditch should be constructed around stockpile A. <br />d.09 Excess Spoil <br />Actual construction o.f the Cast Dumn has not begun, as reported last month. In <br />a meeting with Scott Patten and PFa1t Ayers, it was determined that the activities <br />observed Last month were extensions of the Flors eshoe Dump. The provisions of pages 8R (A) <br />and RR (B) are still reguired as the initial stac7es o.f Cast Dump construction are begun. <br />9.15 Revegeta ti on <br />Pond embankments, road embankments, and the inactive portion of topsoil stockpile <br />A have aIZ been reseeded. <br />
