III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection of the Bear Mine. It was flown by <br />Harry Ranney on April 12, 1996 and reviewed by Tony Waldron on May <br />10, 1996. The mine is active and produces approximately 500,000 <br />tons of coal per year. <br />The review consisted of examining the land slide that occurred at <br />the end of March. The slide moved approximately 50 feet before it <br />stabilized. In the process the switchback portion of the Mine # 3 <br />access road was severely impacted. Fortunately, the ventilation <br />fan did not move a significant amount, although it was slightly <br />impacted. The operator promptly notified the Division when the <br />slide activated and future mitigation actions have not yet been <br />discussed. <br />The sediment pond was holding a fair amount of water. The operator <br />is planning to perform cleanout maintenance on the pond this fall. <br />
