(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn-i99g-n.SR <br />INSPECTION DATE: n~nP ia,2pni INSPECTOR=S INITIALS: C'RM <br />OBSERVATIONS <br />This was an inspection done by Carl Mount of the Division of Minerals and Geology in response to a telephone <br />call and follow-up letter from the operator indicating that mining-related disturbance had inadvertently been <br />done outside the permitted area to the west in the part of the pit that is north of the gas line crossing the permit <br />area. <br />The operator posted the required reclamation bond and succeeded to the approved permit application on <br />June 30, 1999. The permit was issued that same day. <br />Connell Resources has disturbed land with activities that would be considered mining (see the definition of <br />"mining operation" in the Rules) in the northwestern part of the permit area up to the fence that appeared to <br />be the land boundary marker to the west. Unfortunately, the southern end of the fence was placed <br />approximately 30 feet to the west of the land boundary so Connell has disturbed a wedge of land that is <br />approximately 30 feet wide at the southern end tapering over 530 feet to nothing. This gives a surface area of <br />approximately 0.2 acres that has been disturbed. Once it was known that land had been disturbed outside the <br />permit area, the operator backfilled the pit run gravel material up to the level of the overburden. This <br />backfilling was observed during the inspection. See PV 1 on page 3 of this report. <br />Possible parties that have been affected by the disturbance outside the present permit area include the State <br />of Colorado Land Board (represented by Ms. Beverly Rave), Ms. Edna Tellier (the mineral lease holder), and the <br />Tellier Family Trust (surface leaseholder represented by Mr. Frank Camilletti). The operator will need to obtain <br />statements from these possibly affected parties regarding legal right to enter and disturb the area outside the <br />present permit area. <br />Generally, the mining in the northwest part of the pit is completed. Some pit run material is still present to the <br />west and two stockpiles of roadbase material is located on already mined, graded areas. A berm has been <br />constructed below the pit area to intercept runoff from disturbed areas. Topsoil is stockpiled to the east of the <br />excavated area. The gas line area has been adequately marked and orange construction fencing has been <br />erected on the area that is not to be disturbed on either side of the pipeline. <br />The pit is orderly and housekeeping is clearly of importance to the operator. The entrance road has been <br />paved to reduce dust and the operator excavated the road and scale house area down in place on the east <br />to reduce noise and the visual effects of the scale house to surrounding neighbors. <br />I & E Contact Address <br />NAME: Mr. Tonv A.
