IIi. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Continents also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented <br />the operator during the field inspection or records check. The records are in the Delta County Clerk <br />and Recorders Office in Delta. The reclaimed mine site was covered in snow, except for some of the <br />south-facing backfilled and graded slope. <br />Roads <br />The road up Hubbard Creek Canyon was frozen and passable but some areas had deep ruts. The access <br />road leading to the gate and up to pond 5 was passable. The front gate was locked. <br />Sits and Markers <br />The mine ID sign was up on the entrance gate. Surface disturbance markers were up around the site. <br />HvdroloQv <br />There was only snow in Pond 4. Spillways were functional and the embankment appeared to be stable. <br />There was some ice-covered standing water in Pond 5, well below the discharge elevation. The gated <br />primary valve was closed. Pond inslopes and outslopes were stable. <br />The collection ditch leading to Pond 5 had enough capacity. The upland diversion ditch behind the <br />reclaimed coal stockpile area also had sufficient capacity. The culvert that brings disturbed area water <br />from the reclaimed coal stockpile area to Pond 4 was covered in snow. <br />Reclamation <br />There were no signs of slope instability with the backfilled and graded benches of the mine site and at <br />the reclaimed road. The backfilled highwall appeazed to be stable as well. There was no water coming <br />out of the underdrain pipes or out of the black pipe on the north side of the site. <br />Records <br />The records were in compliance, as shown on the attached records checklist. <br />c:/word/blueribbon/insp0106 <br />
