III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of CDMG. Ron Thompson of <br />Peak Project Management represented Picketwire Processing LLC during the <br />inspection. This former underground mine is used for processing and loadout of <br />coal produced from the Lorencito Canyon Mine (4~C-96-084). The site is currently <br />in active status, but will likely go into temporary cessation until activities at <br />Lorencito Canyon resume. Coal stockpiles have been reduced to a minimum by moving <br />coal into the coal silos for future use. Ground conditions on this day were damp <br />due to recent rains and a thunderstorm occurred during the inspection. <br />Signs and Markers <br />New stream buffer zones signs were noted along the Purgatoire River as it bisects <br />the mine site. The mine entry sign is in compliance with Rule 4.02. The MSHA <br />number is posted on the decorative mine sign at the entrance. <br />Hydrologic Balance <br />Sediment ponds were visited and the following observations noted; <br />Pond 7 was one foot below the lowest set of holes on the primary riser. Pond 4 <br />also held a small puddle of water. Pond 8 at the RDA has received some runoff <br />since the last inspection but continues to be some 3-4 feet below the lowest <br />discharge point. The armored 100-year storm event downdrains flanking the Refuse <br />Disposal Area appear in good condition. Straw bales were noted at the coal loadout <br />point east of the coal silos. <br />Fish and Wildlife <br />A black bear was observed on the west mine area during the inspection. <br />Overall, the site appeared in good condition. <br />3 <br />
