This was a complete inspection conducted by Jim Burnell of CDMG on Wednesday, <br />December 5, 2001. There had been a significant snowfall the previous night and there was <br />about 2 to 3 inches of snow at the facilities area; much more snow at the Hubbard Creek <br />sites. There was a good stockpile of coal with approximately a month before the next <br />longwall move. The inspection was accompanied by Mark Milner of Oxbow Mining, LLC. <br />The road up Hubbard Canyon to the sites there was in good condition, although the snow <br />was progressively deeper farther up the canyon. At the upper site (adjacent to the Blue <br />Ribbon Mine), there was a good 12 inches of snow. The Hubbard Creek sites appeared in <br />good condition through the snow. <br />The road up Elk Creek was in very good condition, as it was traversed at a lower altitude <br />than the Hubbard Creek road. Straw booms have been installed on the cut slope and <br />appear to be working effectively. The West Valley gob pile was snow-covered. The back <br />portion was very soft. There was snow in the pond. The pile is filled to about half its <br />capacity. Plans for a new waste pile development should be coming soon. <br />The C-pond road was in good condition. Straw bales are installed in the ditch. <br />The Elk Creek pond contained water about 32 inches from the outlet. There was a steady <br />flow of melt water into the pond. The slopes above the new Elk Creek portals appear to be <br />stable. Entry development has been proceeding well; on the east entry, there is seven feet <br />of coal on the current face. At the upper end of the Elk Creek facilities area, there was a lot <br />of construction activity. The substation, a water tank and a shaft were all actively under <br />construction. The shaft was still in alluvium -had not yet reached bedrock. The area was in <br />good condition with no problems noted. <br />Material from the beltline was not escaping and was contained by the berm constructed on <br />the outslope. The SAE (small area exemption) at the intersection of the beltline with <br />Sanborn Creek, was in good condition. Both straw bales and silt fence are in use at this <br />location. The water trickling through to the creek was clean. The P-1 SAE includes a rather <br />small drainage area. Lots of water, however, is introduced into the SAE area from the <br />beltline. In fact, at each transfer station water collects from the beltline. OMLLC collects the <br />very wet sediment regularly (daily) and transports it to a pond. At P-1 there is a low spot <br />where the beltline water collects. The SAE itself appears to work effectively, given the <br />limitations of topography and facilities. Flowing through a culvert beneath the railroad tracks, <br />and then the highway, the water ultimately flows across a grass filter into the North Fork. <br />The same limitation is encountered at several locations along the conveyer. <br />Judging by the amount of snow up Hubbard Creek, the Bear Creek road and the road to the <br />gob vent borehole sites were inaccessible. There was no work going on at the GVB sites. <br />One driller had been dismissed and the replacement is not due on site until after Christmas. <br />The the substation at Hawks Nest, the topsoil pile appeared in good condition, with no <br />erosion or instability. Pond A will be pumped to Pond B. <br />The reclaimed road, used temporarily for fire suppression, was in excellent condition. <br />Records were checked and several items need to be updated, but they were generally very <br />well kept and easily accessible. <br />
