III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the New Horizon Mine conducted on June 18, 2007 by Mike <br />Boulay of the DMG. Ross Gubka of Western Fuels-Colorado (WFC) was present during the <br />entire inspection. Weather conditions were sunny and hot. Ground conditions at the mine site <br />were very dry. The current active pit area was inspected. At the time of the inspection, coal was <br />being loaded and overburden was being hauled. <br />Availability of Records <br />All required records were on site and available for review. Please see the attached records <br />checklist at the end of this inspection report. <br />Roads <br />Haul roads and access roads were in good condition throughout the site. <br />Hvdrologic Balance <br />Sedimentation Ponds 007, 008, 009, O12, and 014 were inspected. Pond 007 was the only pond <br />discharging. Most of the discharge from outfall 007 is the result of water being pumped from the <br />pit. It appears that less groundwater is being encountered in the current pit than in some of the <br />previous pit locations. Approximately 200 gallons per minute were being pumped from the <br />active pit to Pond 007. Pond 008 was retaining water but at a level well below the principal <br />spillway. Ponds 009, 012, and 014 were dry. <br />SupUOrt Facilities <br />The surface facilities area was inspected. The facilities and perimeter areas are well maintained <br />and no problems were noted during this inspection. <br />Reve etg ation <br />Vegetation on reclaimed areas in the NH-2 mine area appears to be in good condition and well <br />established. Vegetation on the reclaimed NH-1 mine area is not so well established and already <br />turning brown. Hay cutting has begun in several location of the NH-2 mine area. Hay has been <br />cut on a significant portion of the Burbridge property. <br />ICnapweed was identified around the perimeter of Pond 009. To ensure compliance please <br />control the growth of noxious weeds by spraying. <br />
