C. Impacts of Alternative 3, Approval with a Condition <br />j .. <br />'~;-~Jl The preferred alternative is approval with a condition. The impact <br />analysis of the proposed action identified certain impacts that <br />could and should be mitigated by the addition of special conditions <br />to the mining plan approval. This special condition requires: <br />"The lessee/operator shall contribute a sum of $22.00 to the U.S. <br />Fish and Wildlife Service CU$FWS) Upper Colorado River Basin <br />endangered fishes conservation fund within 30 days of mining plan <br />approval and provide OSMRE verification of this contribution within <br />14 days of payment. Should there be any changes in the amount of <br />water depletion predicted for this mine plan or any other project <br />change from that which was approved and which may affect any <br />endangered or threatened species, OSMRE shall be contacted to <br />determine if further consultation with USFWS is required." <br />5. Previous Environmental Impact Statements and Assessments <br />Environmental studies on the McClane Canyon mine prepared by Federal <br />agencies include the following: <br />"East-Central Colorado Coal Environmental Impact Statement", 1978. <br />Bureau of Land Management <br />"McClane Canyon Hine Environmental Assessment", 1982.
