(Page 2) <br />MINE ID # OR PROSPECTING ID #: M taRt-~7F <br />INSPECTION DATE: a-nt-ro INSPECTORS INITIALS: ~_ <br />OBSERVATIONS <br />This was a full permit inspection of the Wes Hertzog Pit. The inspection was done in response to the operator's request <br />for a partial release of reclamation responsibility and a financial warranty reduction. The current financial warranty is <br />$100,000.00 which was posted as a result of an inspection done on December 16, 1999 when it was determined that <br />there was significantly more than the 10 acres of active disturbance as specified in the approved mine plan. At the time <br />of this inspection it was verified that the operator had backfilled and graded 90% of the previously disturbed area and had <br />topsoiled 75% of the graded area. A recalculation of the necessary financial.warranty has been done, based on the need <br />to seed twenty acres at this time (the majority of the regraded currently disturbed site, which should be seeded late this <br />fall) and what will be needed in the future, assuming that the operator will restrict the actively disturbed area to 10 acres <br />at a time, as committed to in the approved mining plan. The estimated bond is $34,500.00. A copy of the cost estimate <br />is enclosed, and a financial warranty reduction approval letter wilt be send at the conclusion of the 30 day public comment <br />period. <br />During the inspection the operator asked about changing the currently approved seed mix, a change was requested by <br />the landowners, Paul and Rosemary Hertzog, via a letter to the DMG received on July 1, 2002. The inspector is agreeable <br />to seeding crested wheatgrass as long as the seed mix does not contain any more than 50 % by weight of this species. It <br />was also suggested that the remainder of the mix could be slender wheatgrass, although a part of it could also be <br />western or intermediate wheatgrass. A question was also raised about leaving the haul road in place after mining. The <br />inspector requested that the landowner submit a letter requesting that the road be left for his access to the land. On <br />August 7, 2002 the Division received this letter, the road may be left after mining. <br />A Permit ID sign is posted at the site and permit boundary markers are in place. It appears that the pit is currently in <br />compliance with the DMG's Rules and Regulations.
