~''1 <br />III. Comment"s -Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />On January 17, 1991 a complete inspection was conducted at the <br />Deserado Mine. Present at the inspection was Tlm Chervick of Deserado <br />and Randall Price of MLRD. At the time of the Inspection the weather <br />was clear and cold. There was about 8 Inches of snow on the ground <br />which made travel on the smaller roads difficult to Impossible. <br />The warehouse yard area was Inspected. The drum storage area mentioned <br />in my November inspection report was cleaned out, a plastic liner was <br />put down and this area was then bermed. The plastic liner was covered <br />with snow but appears that it wilt work effectively. No problems were <br />noted with the drainages or the snow removal In the facilities area <br />At the time of the inspection Tim Chervick took a NPDES blo-monitoring <br />water sample at the wash plant. The sample appeared fairly clear. This <br />mines problems with water flea mortality have ended with the use of a <br />more robust flea that is more tolerant to the high chloride of the <br />discharge. The last sampling did not have a mortality that exceed <br />NPDES limitations. <br />The refuse area was inspected. No problems were noted here. The snow <br />on the active refuse area was cleared prior to refuse placement and <br />the refuse was spread out to dry. Two golden eagles were observed <br />perched on the power poles adJacent to the refuse area Also about <br />40-50 elk were noted on a ridge top about a mile away. Ail roads were <br />frozen solid so mud was not a problem. <br />Records were checked and all were found to be In order. The Deserado <br />mine has applied for"~additional coal lease area known as the Prairie <br />dog lease. At the present time the lease is being reviewed by Federal <br />agencies. <br />r _ . <br />
