III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the inspection. There was no snow cover at the loadout. <br />Hydrology <br />The embankment of the east sediment pond was well vegetated. Pond inslopes were also stable. The <br />sediment pond had standing water to within three feet of the gated primary dischazge pipe..The gated <br />valve was closed. The emergency spillway was functional. The west dugout pond was dry. The <br />spillway was functional. <br />The operator has placed new straw bales around the culvert drop inlet on the east side of the track <br />siding area. The central railroad track culvert that passed private Deer Trail Ditch water under the <br />tracks has been plugged up by the operator. The irrigation water is now flowing down the west side of <br />the property and under the railroad tracks through the west side track culvert. Collection and diversion <br />ditches were functional and topsoil stockpile signs were present. <br />Roads <br />The paved main haul road was in very good condition. The guard rail was in place. The graveled east <br />entrance road was in good condition, as was the railroad track road. <br />Sims and Markers <br />Mine ID signs were up at the appropriate locations. Permit boundary markers were also up. <br />Facilities ' <br />During the inspection, coal haul trucks were unloading and railcars were being loaded. Yet, no fugitive <br />dust was observed: ot£site. Also, there weie no signs of coal or dirt being tracked onto the highway. <br />There is very little material being stored at the material storage area on the east side of the loadout site. <br />No problems were observed there or at the office area, substation or facilities bench.
