(Page 3) • <br />MINE ID # OR PROSPECTING ID # M-78-072 <br />INSPECTION DATE 11/13/95 INSPECTOR'S INITIALS RCO <br />of the offeite pit ie continuous with the floor of the adjacent permitted pit. Part of the <br />resulting elope has been graded to lees than 3:1, but there is a vertical highwall present <br />too. It is not stable, and sloughing ie approaching the county r-o-w fence on the east. The <br />operator stated that the mining was conducted by a local private company in 1982. The <br />company had asked the county about a material source, and was directed to this permit area. <br />The material taken, however, was not from within the permit boundaries. The operator stated <br />that all this disturbance was on their land, and it would eventually get reclaimed by them. <br />This condition of offeite disturbance is noted ae a possible violation under the tonic of <br />"offeite damage" on page 1. and corrective actions explained on the last page. <br />Part of the pit area under the vertical highwall (about 0.5 acre) ie now used by the county <br />for concrete rip rap storage. Rip rap ie kept stockpiled for specific, infrequent uses. <br />It is a material that does not originate from the permit area, and Lincoln County does not <br />need to stockpile it inside a permit area. The presence of the rip rap somewhat limits <br />accessibility at this time to the vertical wall of the pit. The longterm stability of that <br />wall ie questionable. Corrective actions will be ordered by the Mined Land Reclamation <br />Board, and could include enlarging the permit area to include this disturbance and/or <br />beginning reclamation of that area. Before commencing any activity on the area in question, <br />please contact this inspector. <br />This matter will be pursued ae a possible violation for offeite damage, because the <br />excavation ie related to the permit area, and to have been carried out with the operator's <br />consent. The operator ie reminded that other parties may operate within the operator's <br />permit, but the operator is responsible for all disturbance inside the permit, and offeite <br />disturbance also if it is related to a permit area. Portions of the Construction Materials <br />Act (CRS 34-32.5-101, et seg.), specifically Sections 109(1) and 116(4)(1), require that an <br />operator obtain a reclamation permit and that all areas offeite will be protected during <br />mining and reclamation. <br />A notice will be sent to the operator under separate cover, which will state that this <br />Division has reason to believe that a possible violation has occurred.
