III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />Unit Train Loadout <br />All three gates were open and a mine ID sign was up at each entrance. The sediment pond was dry. The bin wall <br />embankment of the pond was stable and the gated valve was closed. There was irrigation water flowing through <br />the upland diversion ditch and culvert above the sediment pond. The berm on the north end of the disturbance <br />near the Farmer's Ditch was functional. Irrigation water was flowing through the Farmer's Ditch. The straw <br />bales at the top of the orchard access road need to be replaced. <br />The central upland diversion system was functional. Irrigation water was flawing through that diversion system <br />as well. The upland diversion ditch that leads from the east entrance gate to the central diversion ditch needs <br />some cleaning. The operator was in the process of repairing the railroad culvert that leads to the sediment pond. <br />The west side collection ditch had sufficient capacity. <br />The concrete pad at the demolished silos is still intact. The operator continues to ship out the gravel sized <br />concrete for use underground at the Bowie No. 2 Mine. Some railroad rails, mining equipment and drilling <br />equipment are still on site. The topsoil stockpile was well vegetated and the topsoil sign was up. The sediment <br />control for the railroad gravel storage area was in place. The silt fence along the reclaimed railroad track needs <br />repair, however. <br />Well Field <br />The dirt road leading to the site was dry and passable. The mine ID sign was up at the site entrance and surface <br />disturbance markers were up around the disturbed area. There was some thistle on the topsoil stockpile and this <br />should be sprayed. The vegetative cover on the stockpile was good. The topsoil sign was up. <br />Hi hwa~Coal Stockpile <br />The coal has been removed from this site and the area has been covered in soil. The dirt road at this site was dry <br />and passable. The mine [D sign was up at the entrance and surface disturbance markers were up as well. The <br />sediment pond was dry. The cut slope was stable and had a good stand of vegetation. On the west side of the <br />site, irrigation water was flowing in the irrigation ditch and through the straw bales placed at the inlet to the <br />railroad culvert, as designed. <br />Run-of--Mine Stockpile Area <br />There was a locked cable across the haul road entrance. A mine ID sign was also up at this location. Surface <br />disturbance markers were up around the site. The haul road was in very good condition. The top of the pile was <br />dry. The topsoil stockpile was well vegetated but the sign was off of its post. There was no water in the sediment <br />pond. The pond embankment was stable and culverts and ditches were functional. <br />Records <br />The required records were on site, as shown on the attached records checklist <br />c:/word bowie 1 /insp0807 <br />
