". ~~ <br />INSPECTION REPORT - PAGE: 2 <br />FILE N0. 8]-158 <br />DATE: April 9, 1984 <br />OBSERVATIONS OF IMPORTADICE: <br />The adequacy letter front Southwest Properties of November 18, 1981 stated the <br />following: <br />1. Topsoil would be stockpiled on the south side of the pit No. 1 and <br />seeded. <br />2. The mining will be: kept 50' from the wommer ditch. <br />3. A new map would show all operations areas. <br />4. The pit edges on the No. 2 pit will be sloped and stabilized. <br />5. Pit No. 2 will be divided into two equal ponds by a berm and roadway; <br />headgates and culverts will be installed between both ponds; and a chlorine <br />contact chamber installed. <br />6. Both pits No. 1 and 2 will contain water and only minimal shore area <br />will need to be revegetated and topsoiled. (Approximately 2 acres.) <br />To date, items 1-5 have not been carried out and the area now appears to be <br />abandoned. This observation is borne out Mrs. Chesnut's letter of <br />September 29, 1983, which states they have not mined since April of 1982. <br />In addition, it appears that they have not complied with Mike Stanton's letter <br />of November 20, 1981, specifically not complying with topsoil salvage <br />requirements, 3:1 sloping, and appearing to have exceeded the 7.74 acre permit <br />area. (See map.) <br />In addition, the financial warranty is too low because more than 2 acres of <br />mined area is exposed and not covered by water as proposed by Southwest <br />Properties. <br />The 1982 annual report <.;tates that Southwest Properties has mined 1/2 an acre <br />in 1982 and proposed to mine 1/2 an acre in 1983. It appears that this is not <br />the case, given observation and letter stating no mining has occurred for over <br />1 1/2 years and neighbor testimony that the Forest Lake subdivision is going <br />bankrupt. <br />RECOMMENDATIONS: <br />A violation be found and cease and desist order issued by the Board, <br />2. Civil penalties sFiould be assessed and paid. <br />3. Corrective reclamtition be carried out during summer and fall of 1984. <br />
